Access to the Best Bear CV database (full details and email service)

Access to the full CV database and email service is conditional upon registration and payment confirmation. Following receipt of your payment we will grant you a non-exclusive, non-transferable licence to use the on-line CV database and email service for 30 days.

This licence to use the on-line service is granted subject to the terms and conditions listed below, in addition to our standard Best Bear disclaimer.

Details of our prices for access to our CV database and email service and the procedures for payment are displayed on our website www.bestbear.co.uk.

You must pay in advance either by using the online payment interface or by cheque at the time of your subscription request.

The price of any subscription is the price in force at the date and time of your order. We may change the price of any of our services before you place a subscription request. We try to ensure that our prices displayed on our Website are accurate, but the price on your order will need to be validated by us as part of the acceptance procedure. We will inform you if the subscription’s correct price is higher than that stated in your subscription request and you may cancel the order and decide whether or not to subscribe to the services at the correct price. We are entitled to refuse any subscription placed by you.

If your subscription is accepted, we will confirm acceptance to you by on-line electronic means to the email address you have given on registration. The on-line service will be made available to you via email in your in-box on confirmation.

Any access, password and the above licence(s) will automatically terminate at the end of the 30 days period unless renewed.

CVs and job advertisements contained on the site are provided by candidates and by prospective employers and their agents and are not reviewed by us. We accept no responsibility or liability for the contents of CVs or advertisements and expect candidates and prospective employers to carry out such verification procedures as are customary and prudent in the circumstances.

You may not:

- Supply, sell or license material from the candidate database, or a copy of it, to any other person, including another member of your group of companies.

- Contact the individuals on the database or make or allow any use of the information about those individuals, other than for the purpose of discussing a specific job vacancy.

You may use, print and download information from the site for these purposes only and for no other personal or commercial purpose. You may not otherwise copy, display, transmit or distribute any material from the site.

Best Bear Childcare is not to be considered to be an employer with respect to your use of this website and we shall not be responsible for any employment decisions, for whatever reason made, made by any entity posting jobs on our website.

You undertake that all details you provide to us for the purpose of subscribing to the services will be correct, that the account details, cheque, credit or debit card or any electronic switch (whichever is applicable) you use is your own and there are sufficient funds or credit facilities to cover the cost of any subscription. We reserve the right to obtain validation of your credit or debit card details before providing you with any Services.

Employment agencies and employment businesses

If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973) it is your responsibility to ensure that the use you make of information from our candidate database complies with your obligations under the Act and the various regulations made under it, together with any applicable guidelines. These regulations are currently contained in the Conduct of Employment Agencies and Employment Businesses Regulations 2004. You agree to comply with the Act and these regulations as they affect the conduct of your business and the use you make of information on our candidate database.

Returns/refund policy

The Distance Selling Regulations would ordinarily say that you have 7 days from the date of confirmation from us of your order to change your mind and cancel the order. In that case we would provide a full refund less the direct cost to us of the return of any items already delivered to you which (unless this is seen as a breach of the Distance Selling Regulations) would include the direct cost to us of their carriage to you and their return.

Your subscription can be terminated at any time by you upon written notification to us, however, as you consent to the service being provided immediately and as they are provided by software which you open (either to search our database or to place an advert on our website), the Distance Selling Regulations do not apply and no refunds will be given without valid cause and subject to your statutory rights.

We want you to be happy with any service we provide to you. Whilst our legal position is spelt out in plain English above, we will consider a refund in any case where there is proper cause for complaint. We will do all we can to help you. Please contact us to discuss further if you feel you have a valid case for a refund.

Currency

All figures mentioned on this site or by our representatives are £ sterling. Unless otherwise expressly stated in writing, all prices are exclusive of VAT which shall be charged where appropriate at the rate prevailing at the relevant tax point.

Governing law

These terms and conditions shall be interpreted in accordance with English law and all disputes shall be decided by the English courts.
